To start, Arizona takes a more general approach to sex crimes.

Rather than use the term “sex crime,” Arizona uses the term “sexual offense.” Sexual offenses are categorized in Title 13 of the Criminal Code, Chapter 14.

Below are the three types of sexual offenses that do not involve sexual intercourse:

  • Indecent Exposure: This act is the exposure of the genitals, anus or female breasts, in the presence of another person. For this to be considered a criminal act, the exposed individual must be reckless in regard to whether the present individual would be reasonably offended by the act.

  • Public Sexual Indecency: There are actions that do not involve intercourse, but are considered public sexual indecency. Under A.R.S. 13-1403, a person engages in public sexual indecency by intentionally or knowingly touching another person in a sexual manner. This act also depends on whether present company is offended.

  • Molestation of a Child: The third type of sexual offense that does not include intercourse is the molestation of a child. This sexual offense is explained in A.R.S. 13-1410. Under this section, a person commits molestation of a child by intentionally or knowingly engaging in or causing a person to engage in any sexual contact with a child who is under fifteen years of age.
